Terms of use

These terms apply to the use of Nextdive, offered by Dylan Prins, reachable at prins.dylan@outlook.com. By creating an account you agree to them. How we handle your data is described in the privacy policy.

1. Your account

• You are at least 16 years old, or you use Nextdive with the permission of a parent or guardian.
• An account is personal. You keep your sign-in details secret and are responsible for what happens with your account.
• You can delete your account yourself at any time from your profile.

2. Nextdive is a logbook, not a safety tool

Nextdive is meant for recording dives and looking back on them. It is not a dive planner, decompression or gas calculator and never replaces your dive computer, your training, your certification limits or the judgement of your instructor. Warnings in the app (for example about depth compared to your certification) are only a reminder and may be incomplete or wrong. Imported data may differ from what your dive computer measured, so check it yourself.

3. Your data and content

• What you put in Nextdive (dives, notes, photos) stays yours. You only allow us to store and show it as far as needed to make Nextdive work, for example to buddies you tag.
• You are responsible for what you write about others, such as buddy names and notes. Do not add anything that is unlawful, offensive or that you may not share.
• You can always export your dives as CSV. Make a copy now and then: we do our best, but cannot guarantee that data is never lost.

4. Buddies and dive schools

• A dive on which you tag someone is visible to that buddy, who can copy it to their own logbook.
• Dive schools use Nextdive to arrange group dives, buddy teams and rental gear. Agreements about taking part, prices, rental, payment and liability during dives are made with the dive school, not with Nextdive. Nextdive is not a party to them.
• Owners and staff of a dive school are responsible for what they put in Nextdive and for how they use their members' data.

5. Connections with Garmin, Suunto and other services

• Connections with third-party services are optional and work through their APIs. Those services may change, limit or stop their API at any time, so a connection may stop working temporarily or for good. Importing files always remains possible.
• Your use of Garmin Connect and Suunto remains subject to their own terms.
• Garmin, Garmin Connect, Descent and Suunto are trademarks of their owners. That Nextdive can connect with them does not mean they recommend or endorse Nextdive.

6. What is not allowed

Abusing Nextdive, such as: trying to sign in to someone else's account, collecting other users' data (scraping), overloading the service or circumventing security. In case of abuse we may block or delete your account.

7. Availability and changes to the service

We aim for Nextdive to always work, but cannot guarantee it. Maintenance, outages or changes at service providers can make the service temporarily unavailable. We may add, change or stop features. If Nextdive shuts down entirely, we announce it at least 30 days in advance so you can export your dives.

8. Costs

Nextdive is currently free. If paid features or subscriptions are introduced, price, term, cancellation and right of withdrawal are stated clearly beforehand. You only agree to them when you sign up for them yourself. Features you already use for free never become paid retroactively.

9. Liability

Nextdive is provided as is. We are not liable for damage caused by using (data from) Nextdive, for decisions you make above or under water, or for connections with third parties that stop working. Where liability does exist, it is limited to the amount you paid Nextdive in the 12 months before, or €50 if you paid nothing. These limits do not apply in case of intent or gross negligence and do not affect your rights as a consumer.

10. Changes to these terms

We may change these terms. We announce important changes in the app at least 30 days in advance. If you do not agree, you can export your data and delete your account.

11. Applicable law

These terms are governed by Dutch law. If you are a consumer in another EU country, you keep the protection the law of your country of residence gives you. We first try to resolve disputes together; contact us at the address above.
